Right of Withdrawal
You have the right to withdraw from this contract within 30 days without giving any reason.
The withdrawal period is 30 days from the date:
• on which you, or a third party designated by you (who is not the carrier), took possession of the goods, provided that you ordered one or more goods in a single order and they were delivered together;
• on which you, or a third party designated by you (who is not the carrier), took possession of the last good, provided that you ordered multiple goods in a single order and they were delivered separately.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract. You can do this via email: support@nuwju.co.za.
You may use the attached model withdrawal form, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the withdrawal period expires.
Effects of Withdrawal
If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the standard delivery offered by us), without undue delay and within 30 days at the latest after receiving your withdrawal notice.
We will use the same payment method for the refund that you used for the original transaction, unless expressly agreed otherwise. In no case will this refund incur additional costs for you.
We may refuse the refund until we:
• have received the returned goods, or
• you have provided proof that you have returned the goods, depending on which occurs first.
You must return the goods to us or hand them over to us without delay and no later than 30 days from the date on which you informed us of the withdrawal from the contract. The deadline is met if you return the goods before the 30-day period expires.
The direct costs for returning the goods are your responsibility.
You are only liable for the diminished value of the goods if the loss in value is due to handling the goods beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
Reasons for Exclusion and Expiry of the Right of Withdrawal
The right of withdrawal does not apply to contracts:
• for the delivery of goods that are not prefabricated and that are made based on the consumer's individual choice or decision;
• for the delivery of goods that are perishable or have a limited shelf life;
• for the delivery of alcoholic beverages whose price was agreed upon in the contract, but which can only be delivered 30 days at the earliest after the conclusion of the contract and whose value depends on market fluctuations;
• for the delivery of newspapers, periodicals, or magazines, except for subscriptions.
The right of withdrawal expires early in contracts:
• for the delivery of sealed goods which are not suitable for return for health or hygiene reasons, if the seal has been broken after delivery;
• for the delivery of goods that have been inseparably mixed with other goods after delivery due to their nature;
• for the delivery of audio or video recordings and computer software in sealed packaging, if the seal has been broken after delivery.
